What is Maryland Probate Law?
Maryland Probate involves the court-supervised process that allows for the distribution of your assets upon death. While some of your assets may automatically be transferred to another party outside of the Maryland probate process, the remainder we need to be retitled and distributed to your heirs. The remaining assets may either be distributed according to the terms of the decedent’s will or to the intestate laws of the State the decedent was domiciled in when they passed. Furthermore, the process ensures that all of your legitimate debts, bills, taxes, and outstanding notes are paid.
What is the Probate Process?
When a will is filed for probate, the Maryland Probate Court appoints a Personal Representative, also known as an Executor, to oversee the estate. The Personal Representative is often designed in the decedent’s will. The main role of the Personal Representative is to carry out the terms of the will. The Personal Representative also handles other administrative tasks involved in the probate process. For example, the Personal Representative may execute legal documents on behalf of the probate estate, write checks from the probate estate, and oversee any remaining business affairs of the probate estate. The Maryland probate process may take in excess of a year, and often may be very challenging for many families to navigate on their own.
